The European Commission published a Delegated Regulation amending Part 3 of Annex VI to Regulation (EC) No 1272/2008 on Classification, labelling and packaging of substances and mixtures (CLP Regulation). The amendment classifies allergen Butylphenyl Methylpropional (BMHCA), more commonly known as Lilial, as a CMR 1B substance. The allergen is present in many fragrance ingredients found in cosmetics.
Cosmetics Regulation (EC) 1223/2009 prohibits the use of substances classified as carcinogenic, mutagenic or toxic to reproduction (CMR) under the CLP Regulation in cosmetic products, unless there is an exemption in line with the Article 15 of the Cosmetics Regulation.
This new classification of Lilial will apply from March 1 2022. The exact date of prohibition of Lilial in cosmetics products is not known yet but we advise the cosmetic manufacturers to start replacing their fragrances with Lilal-free fragrances.
