Spain new labelling requirement

Spain is introducing updated packaging regulations under Royal Decree 1055/2022, which will take effect on January 1, 2025. These changes aim to promote better waste management and environmental sustainability.

Key Points:

  • Clear Labeling Requirements: Packaging must specify whether it can be reused and indicate how it should be disposed of (e.g., which recycling container to use). For multi-material packaging, if the components can be separated, each part must have its disposal instructions. If they cannot be separated, the labeling should reflect the material that makes up most of the packaging. Labels should be visible, legible, and placed on the outermost part of the packaging.
  • Ban on Misleading Terms: Words like “eco-friendly” or “environmentally safe” are not allowed unless scientifically proven and certified. This measure ensures that consumers are not misled and are encouraged to dispose of packaging responsibly .
  • Registration for Businesses: Any company selling products in Spain must register with the Product Producers Registry managed by the Ministry for Ecological Transition. This ensures compliance with the new labeling and packaging regulations. Registration will involve providing detailed information about the packaging materials, volume, and end-of-life management plans
  • Extended Producer Responsibility (EPR): Starting in 2025, businesses will also need to meet EPR requirements for all packaging types, including industrial and commercial. Companies must fund and manage the collection, recycling, and proper disposal of their packaging waste

These updates are part of Spain’s broader effort to support a circular economy by encouraging recycling, reuse, and waste reduction. Companies operating in Spain are advised to prepare for these regulations to avoid penalties and to align with sustainability goals.
